Cycling and E-Bike Injury Cases: Navigating the Nuances of the Law

Cycling and e-bike usage are increasingly popular modes of transportation and recreation. However, the legal landscape surrounding these activities is complex and varies significantly from one location to another. As an experienced personal injury attorney, cyclist, e-bike owner, and father of two young bike-riding kiddos, I understand the intricacies of these laws and am committed to advocating for cyclists' rights.

Understanding Local Regulations

The Importance of Legal Expertise

Navigating the legalities of cycling and e-bike usage requires an in-depth understanding of local laws and regulations. Sometimes police and cyclists have a misunderstanding of the laws and jump to conclusions about “fault.” Don’t presume you don’t have a claim! If you were injured on a bike, give us a call to discuss your case. Here’s why having an experienced attorney on your side is essential:

  • Nuanced Legal Knowledge: With laws differing from one jurisdiction to another, a nuanced understanding of these regulations is necessary. I study the latest local ordinance, state laws, and federal regulations to provide accurate and effective legal analysis of these claims.
  • Accident Liability: Determining liability in cycling and e-bike accidents can be complex. Factors such as whether a cyclist was riding on a prohibited sidewalk or not using a required bike lane can impact the outcome of a case. My expertise ensures that all relevant legal aspects are considered.
  • Advocacy and Compensation: As your attorney, I will fight for your rights and work to secure the compensation you deserve. Whether dealing with insurance companies or taking a case to court, my goal is to achieve the best possible outcome for you.

The rules governing where and how a person can ride a bicycle or e-bike can differ dramatically depending on the location/city or even specific areas within a city. Here are some key examples to illustrate this complexity:

  • Sidewalk Riding: Some cities allow biking on sidewalks, while others strictly prohibit it. Even within a single city, the rules can vary. For instance, Provo City prohibits cycling on sidewalks in the downtown area but doesn’t prohibit it in other areas of the city.
  • Bike Lanes: The requirement to use bike lanes also varies. Most of the time cyclists must use designated bike lanes if they are available. But the law recognizes exceptions to this rule. Knowing where bike lanes are mandatory and where they aren’t can be the deciding factor in a cycling injury case.
  • Roadway Usage: Cyclists are generally allowed to use roadways, but there are exceptions. Certain high-speed roads or highways may prohibit cyclists for safety reasons. Conversely, cyclists may have the right to use the full lane, opposed to the right side of the roadway, on narrower roads where it is unsafe for a car to pass within the same lane.
  • Stop Signs are Yield Signs for Cyclists: Did you know that in Utah Cyclists can treat stop signs as yield signs? The Utah Legislature recently changed Utah law allowing Cyclists to yield at stop signs. There are other exceptions to “rules-of-the-road” that apply differently to cyclists, knowing these rules is critical in these cases.
  • 3-Foot-Rule: According to this rule, when a motorist overtakes a cyclist on the road, they must maintain a minimum distance of three feet between their vehicle and the cyclist. This distance helps prevent collisions and ensures the safety of cyclists. Some states have specific laws enforcing this rule, while others rely on it as a general safety practice.
  • Trail Usage: Did you know some trails that allow cyclists can prohibit certain e-bikes? The US Forest Service recently outlined regulations for e-bikes that differ for non-motorized vehicles on trails. Do you know the rules?
